How are crypto gains taxed in France?

In France, capital gains from selling cryptocurrency for fiat currency (euros) or spending it on goods and services are subject to the 30% flat tax (PFU). Crypto-to-crypto exchanges are not taxable events. The taxable gain is calculated using a specific formula based on the proportion of the portfolio sold.

Flat Tax (30%)

Crypto gains are taxed at the flat rate of 30%: 12.8% income tax plus 17.2% social levies. This applies to all disposals to fiat currency.

Disposal Formula

Taxable gain = Sale price - (Total acquisition cost x Sale price / Total portfolio value). This proportional method accounts for partial sales.

Exemption Threshold

If your total disposals for the year are below €305, you are fully exempt from tax. Above this threshold, the entire amount is taxable.

The disposal formula explained

When you sell part of your crypto portfolio, the taxable gain is not simply the difference between buy and sell price. Instead, France uses a weighted formula: you deduct a fraction of your total acquisition cost proportional to the fraction of your portfolio being sold. This ensures fair taxation when you have acquired crypto at different prices over time.

Reporting obligations

French residents must declare all crypto accounts held on foreign platforms (form 3916-bis) and report all disposals on form 2086. Failure to declare foreign accounts carries a €750 fine per undeclared account. Professional traders may be subject to BIC taxation instead of the flat tax.

Frequently asked questions

Are crypto-to-crypto trades taxable?
No. Exchanging one cryptocurrency for another (e.g., BTC to ETH) is not a taxable event in France. Only disposals to fiat currency (euros, dollars) or purchases of goods/services trigger taxation.
What if I have losses?
Crypto losses can offset crypto gains within the same tax year, but cannot be carried forward to future years (unlike securities losses). If your net result for the year is negative, no tax is due but the loss is lost.
Do I need to declare my Binance/Coinbase account?
Yes. All crypto accounts on platforms based outside France must be declared annually on form 3916-bis, even if they have zero balance. French-based platforms (registered PSAN) do not require this declaration.
Can I opt for the progressive tax rate?
Since 2023, occasional investors can choose between the 30% flat tax and the progressive income tax rate (plus 17.2% social levies). The progressive rate may be advantageous if your marginal tax bracket is 11% or less.
